No significant fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to authorize a municipality to adopt and enforce a regulation prohibiting or restricting excessive noise from the discharge of a firearm in the extraterritorial jurisdiction (ETJ) of the municipality or in an area annexed by the municipality after September 1, 1981.

The bill would add Section 229.003 to the Local Government Code to create as a Class C misdemeanor offense the act of knowingly discharging a firearm and the projectile from the firearm travels across a property line of property that is located in the ETJ of a municipality.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2009.

It is anticipated that costs associated with enforcement and prosecution and revenue generated by fines and court costs would not be significant.
