Honorable Robert Duncan, Chair, Senate Committee on State Affairs
FROM:
John S. O'Brien, Director, Legislative Budget Board
IN RE:
SB1912 by Duncan (Relating to the disclosure of personally identifiable information under the public information law.), Committee Report 1st House, Substituted
No significant fiscal implication to the State is anticipated.
The bill would amend the Government Code regarding personally identifiable information collected by each state governmental body. The Comptroller would be required to perform a study of the amount and types of personal information collected by each state governmental body. It is assumed that any additional costs associated with the implementation of the bill could be absorbed within existing state resources.
Local Government Impact
The bill would except the birth date, excluding the month and year, of a current or former employee of a governmental body, and would permit a birth date to be redacted from information a governmental body discloses without requiring a decision from the Attorney General. The fiscal impact to local governmental entities to redact a birth date from information that is disclosed would vary depending on the number of requests an entity received for public information for a current or former employee.
