LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION
Revision 1

May 7, 2009

TO:
Honorable Dan Branch, Chair, House Committee on Higher Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB2045 by Williams (Relating to certain constitutionally dedicated funds allocated to the Lamar Institute of Technology and to the administration of that institution.), As Engrossed

No fiscal implication to the State is anticipated.

This bill would amend Education Code to require the Texas State University System Board to establish and maintain the Lamar Institute of Technology (LIT) as a lower-division institution of higher education. Current statute defines LIT as "an educational center of Lamar University."

Presumably this change would clarify LIT's eligibility to receive Higher Education Fund allocations as a separate institution of higher education, pursuant to Article VII, Sec. 17 (c) of the Texas Constitution.

Senate Bill 2146 and House Bill 4535, both relating to the reallocation of the HEF, would provide a separate allocation to the Lamar Institute of Technology.

Local Government Impact

No fiscal implication to units of local government is anticipated.
