LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 20, 2009

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB2389 by Nichols (Relating to physician staffing requirements for hospitals.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 241, Health and Safety Code, related to a hospital's physician staffing requirements for emergency medical care. The bill would prohibit the Department of State Health Services (DSHS) from establishing requirements for a hospital that would be more restrictive than required by federal law. DSHS indicates that costs related to implementation of the provisions of the bill could be absorbed within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
