LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 24, 2009

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB2438 by Uresti (Relating to imposing a duty on a sheriff to report certain warrant or capias information to a national database.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to require a sheriff, within 30 days of the day the court clerk issues a warrant, to report to the national crime information center each warrant or capias issued for a defendant charged with an offense other than a Class C misdemeanor who fails to appear in court when summoned.

Local Government Impact

The Harris County Office of Budget Management and the Travis County Sheriff's Office both reported that implementing provisions of the bill would require additional staff, at a cost of $381,040 plus $25,000 for office equipment for Harris County and a cost of $40,318 for Travis County in fiscal year 2010. Costs would increase incrementally each fiscal year thereafter; however, these costs are not significant in relation to the budget of the sheriffs' offices.

The cost would vary by county, although no significant fiscal implication to units of local government is anticipated.
