LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 18, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SJR25 by Harris (Proposing a constitutional amendment requiring certain revenue collected by a public entity from the use of a tolled highway project in this state to be used only for transportation projects.), As Engrossed

No significant fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $90,882.

The resolution would propose a constitutional amendment to Article VIII of the Texas Constitution to specify that the revenue collected by a public entity from a tolled highway project other than an international bridge that is not dedicated to the repayment of the project's debt may be used only for the acquisition, construction, operation, maintenance, or improvement of transportation projects.

The proposed amendment would be submitted to voters at an election to be held November 3, 2009.

Based on the analysis of the Comptroller of Public Accounts and the Texas Department of Transportation, it is assumed provisions of the proposed constitutional amendment would not result in a significant fiscal impact to the state.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
