The bill would amend the Penal Code by enhancing the punishment for the offense of criminal mischief to a state jail felony if the amount of pecuniary loss is less than $20,000 and the actor causes wholly or partly impairment or interruption of public communications, public transportation, public gas or power supply, or other public service, or causes to be diverted wholly, partly, or in any manner, including installation or removal of any device for any such purpose, any public communications or public gas or power supply. 

A state jail felony is punishable by confinement in a state jail for any term of not more than two years or less than 180 days, or, in addition to confinement, a fine not to exceed $10,000.

For calendar year 2007 the Department of Public Safety (DPS) reported 15 statewide arrests for the offense of criminal mischief where the offense impaired with a public service. It is assumed that the number of additional offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
