LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

81ST LEGISLATIVE REGULAR SESSION

March 19, 2009

TO:
Honorable Pete Gallego, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1869 by Madden (Relating to a determination of value for purposes of punishment of the offense of abuse of official capacity.), As Introduced

The bill would amend the Penal Code by allowing for the aggregation of funds involved in the offense of abuse of official capacity.  The punishment for the offense of abuse of official capacity ranges from a Class C misdemeanor to a felony of the first degree depending on the amount of the value of the thing misused in the offense.

It is assumed that the number of persons convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
