LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

81ST LEGISLATIVE REGULAR SESSION

April 7, 2009

TO:
Honorable Todd Smith, Chair, House Committee on Elections

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2513 by Hopson (Relating to the procedures for registering to vote and accepting a voter at a polling place; providing a criminal penalty.), As Introduced

The provision of the bill that is the subject of this analysis would amend the Election Code by making perjury committed in the execution of an affidavit for the purposes of being accepted to vote an act of aggravated perjury.  The offense of aggravated perjury is punishable as a felony of the third degree.

A felony of the third degree is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

It is assumed that the number of persons convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies.
