LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

81ST LEGISLATIVE REGULAR SESSION

April 7, 2009

TO:
Honorable Todd Smith, Chair, House Committee on Elections

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB4418 by Dunnam (Relating to voter integrity measures and punishment for related offenses.), As Introduced

The provision of the bill that is the subject of this analysis would amend the Penal Code by including in the offense of fraudulent use or possession of identifying information if one or more items under this section is obtained, possessed, transferred or used by a person to obtain a voter registration certificate or used by a person to cast a vote.  The behavior included in the bill would be punishable as a felony of the third degree.

A felony of the third degree is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

It is assumed that the number of persons convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies.
