LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

81ST LEGISLATIVE REGULAR SESSION

April 8, 2009

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB331 by Carona (Relating to access to certain information under the public information law concerning public officers and employees.), As Introduced

As a result of this bill there will be no significant restriction upon:

(1) the open records law;
(2) the open meetings law;
(3) the access to government information; or
(4) the ability of the citizens of Texas to transact public business.

Current law allows employees, officials, and former employees or officials of a governmental body to choose whether or not to allow public access to personal information. The bill would amend the Government Code to allow public officers or employees to submit a written application to a public information officer to request personal information, such as the likeness of the individual, times of arrival or departure to and from work, a description of the individual’s automobile, or the individual’s parking location to be withheld from public disclosure if public access to the personal information would compromise the safety of the individual.
