LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

81ST LEGISLATIVE REGULAR SESSION

April 8, 2009

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1832 by Patrick, Dan (Relating to the eligibility for judge-ordered community supervision or for release on parole or to mandatory supervision of a defendant convicted of criminal solicitation of capital murder. ), Committee Report 1st House, Substituted

The bill would amend the Penal Code to make individuals convicted of criminal solicitation of capital murder ineligible for judge-ordered community supervision, release to parole supervision, or release to mandatory supervision.

A check of Texas Department of Criminal Justice records indicated that less than five people were placed on judge-ordered community supervision for criminal solicitation and less than five people were released to parole supervision, or mandatory supervision for criminal solicitation of capital murder in fiscal year 2008. Therefore it is assumed that the bill would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
