Pursuant to a notice posted on April 2, 2009, the House Committee on Appropriations met in a public hearing and was called to order by the chair, Representative Pitts, at 8:14 a.m.

 

The roll was answered as follows:

 

Present:              Representatives Pitts; Raymond; Aycock; Brown, Fred; Button; Cohen; Creighton; Crownover; Driver; Edwards; Giddings; Hochberg; Isett; Miller, Doug; Morrison; Otto; Riddle; Villarreal; Zerwas (19).

 

Absent:              Representatives Chavez; Darby; Dukes; Eiland; Flores; Herrero; King, Susan; McClendon (8).

 

A quorum was present.

 

SB 1

 

The chair laid out SB 1.

 

The chair laid out a substitute to SB 1.

 

(Representative Flores now present.)

 

(Representative Darby now present.)

 

(Representative Herrero now present.)

 

(Representative McClendon now present.)

 

Representative Raymond moved the adoption of the substitute.  The motion was adopted without objection.

 

Representative Raymond moved that SB 1, as substituted, be reported favorably to the full house with the recommendation that it do pass and be printed. The motion prevailed by the following record vote:

 

Ayes:                             Representatives Pitts; Raymond; Brown, Fred; Button; Cohen; Creighton; Crownover; Darby; Driver; Edwards; Giddings; Herrero; Hochberg; Isett; McClendon; Miller, Doug; Morrison; Otto; Riddle; Villarreal; Zerwas (21).

 

Nays:                             None (0).

 

Present, Not Voting:     None  (0).

 

Absent:                        Representatives Aycock; Chavez; Dukes; Eiland; Flores; King, Susan  (6).

 

Representative Aycock entered the following statement into the record: "I was not present at the time of the vote because I was laying out a bill in another committee.  If present, I would have voted for the bill."

 

Representative Chavez entered the following statement into the record: "I was not present at the call for the vote.  Had I been present, I would have voted for passage."

 

Representative Dukes entered the following statement into the record: "Had I been present, I would have voted for passage."

 

Representative Flores entered the following statement into the record: " I had already walked into the hearing but stepped out to tend to a constituent case on the phone while the vote was taken.  Apparently, I was in the back room of the Appropriations lounge during the vote and was in shock when I walked back in and it was over and done with.  I respectfully ask for my vote to be counted as a YES for SB 1."

 

Representative King entered the following statement into the record: "I was not present at the time of the vote because I was laying out a bill in another committee.  If present, I would have voted for the bill."

 

At 8:24 a.m., on the motion of the chair and without objection, the meeting was adjourned.
