Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Administration was held on Monday, April 6, 2009, in the E1.714.

The chair called the meeting to order at 3:29 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out the list of bills recommended for placement on the Local and Uncontested Calendar to be held April 9, 2009, at 8:00 AM. 

 

Bruce La Boon, representing Houston Auto Auction, testified in favor of SB 1827.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The following bills were removed from the list: SB 67, SB 361, SB 375, SB 482, SB 809, SB 959, SB 1021, SB 1290, SB 1292, SB 1356, and SB 1743. Senator Uresti moved that, with the exception of the bills previously listed, the bills on the recommended list be certified for placement on the Local and Uncontested Calendar.  The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.

 

The chair laid out SB 1900 and recognized the author, Senator Seliger, to explain the bill. 

 

Senator Whitmire sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed. 

 

Witnesses testifying and registering on the committee substitute are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Williams moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Shapiro moved that SB 1900 do not pass but that CSSB 1900 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 1540 and recognized the author, Senator Carona, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Williams moved that SB 1540 be left pending; without objection, it was so ordered.

 

The chair laid out SB 1756 and recognized the author, Senator Duncan, to explain the bill. 

 

Senator Shapiro sent up Committee Amendment 1 and moved adoption; without objection, it was so ordered.

 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Williams moved that SB 1756 as amended, be left pending; without objection, it was so ordered. 

 

The chair laid out SB 2071 and recognized the author, Senator Duncan, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Williams moved that SB 2071 be left pending; without objection, it was so ordered. 

 

The chair laid out SCR 42 and recognized Senator Uresti, in the absence of the author, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Uresti moved that SCR 42 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Uresti moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Uresti assumed the chair. 

 

There was no action taken for SB 907.

 

The chair laid out SB 909 and recognized the author, Senator Williams, to explain the bill. 

 

Senator Shapiro moved that SB 909 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Williams resumed the chair. 

 

Senator Whitmire submitted a Motion in Writing requesting unanimous consent to be shown voting aye on the following bills: SB 909, SB 1900 and SCR 42.  Without objection, it was so ordered.

 

There being no further business, at 4:39 p.m. Senator Williams moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
