Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Agriculture & Rural Affairs was held on Monday, March 16, 2009, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 3:00 p.m.  The following business was transacted: 

 

The chair laid out SB 344 and recognized the author, Senator Nelson, to explain the bill. 

 

Senator Uresti sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.  Senator Uresti moved adoption of the committee substitute; without objection, it was so ordered. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The chair moved that SB 344 be left pending; without objection, it was so ordered. 

 

The following members arrived after the roll was called:  Senator Hegar, Senator Hinojosa and Senator Jackson.  A quorum was established at 3:15 p.m.

 

The chair laid out as a matter of pending business SB 684 and recognized the author, Senator Lucio, Jr., to explain the bill. 

 

Senator Hinojosa sent up a committee substitute; the chair recognized Senator Lucio, Jr. to explain the difference between the committee substitute and the senate bill as filed.  Senator Hinojosa moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Hinojosa moved that SB 684 do not pass but that CSSB 684 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

At 3:20 p.m. Senator Uresti assumed the chair.  

 

The chair laid out as a matter of pending business SB 252 and recognized the author, Senator Estes, to explain the bill. 

 

Senator Estes moved that SB 252 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Estes moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 3:22 p.m. Senator Estes resumed the chair. 

 

The chair laid out SB 768 and recognized the author, Senator Hegar, to explain the bill. 

 

Senator Hegar sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the senate bill as filed.  Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered. 

 

Witnesses registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  

 

The chair moved that SB 768 be left pending; without objection, it was so ordered. 

 

At 3:27 p.m. Senator Uresti assumed the chair. 

 

The chair laid out SB 948 and recognized the author, Senator Estes, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The chair moved that SB 948 be left pending; without objection, it was so ordered. 

 

At 3:36 p.m. Senator Estes resumed the chair. 

 

There being no further business, at 3:36 p.m. Senator Jackson moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
