Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on Business & Commerce was held on Wednesday, March 18, 2009, at Senator Fraser's Desk.

The chair called the meeting to order at 1:34 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business SB 507.  Senator Eltife moved that SB 507 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Eltife moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 538.  Senator Estes moved that SB 538 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Estes moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

 

 

The chair laid out as a matter of pending business SB 547.  Senator Eltife sent up the committee substitute at a previous hearing.  Senator Eltife moved adoption of the committee substitute; without objection, it was so ordered.  Senator Eltife moved that SB 547 do not pass but that CSSB 547 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Eltife moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 731.  Senator Lucio, Jr. moved that SB 731 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 769.  Senator Harris sent up the committee substitute at a previous hearing.  Senator Harris moved adoption of the committee substitute; without objection, it was so ordered.  Senator Harris moved that SB 769 do not pass but that CSSB 769 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

The chair laid out as a matter of pending business SB 776.  Senator Harris sent up Committee Amendment 1 at a previous hearing.  Senator Averitt moved adoption; without objection, the amendment was adopted.  Senator Averitt requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Averitt then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Averitt moved that SB 776 do not pass but that CSSB 776 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 802.  Senator Harris sent up Committee

Amendment 1 at a previous hearing.  Senator Harris moved adoption; without objection, the amendment was adopted.  Senator Harris requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Harris then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Harris moved that SB 802 do not pass but that CSSB 802 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

There being no further business, at 1:44 p.m. Chairman Fraser moved that the Committee stand recessed subject to the call of the chairman.  Without objection, it was so ordered.
