Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Economic Development was held on Friday, May 22, 2009, in the Betty King Committee Room at Austin, Texas.

The chair called the meeting to order at 9:10 a.m.  The following business was transacted: 

 

The following members arrived after the roll was called:

The chair laid out HB 3222 and recognized Senator Eltife, in the absence of the Senate sponsor, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Harris moved that HB 3222 be left pending to await a quorum; without objection, it was so ordered. 

 

Senator Eltife assumed the chair.  

 

The chair laid out HB 773 and recognized the Senate sponsor, Senator Harris, to explain the bill.

Senator Eltife moved that HB 773 be left pending to await a quorum; without objection, it was so ordered.

 

Senator Harris resumed the chair.   

 

The chair laid out HB 3896 and recognized the Senate sponsor, Senator Seliger, to explain the bill. 

 

Senator Eltife sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the house bill as engrossed.

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Harris moved that HB 3896 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair advised that HB 3676 had been tagged pursuant to Senate Rule 11.19 and would not be heard. 

 

The chair laid out HB 394 and recognized the Senate sponsor, Senator Van de Putte, to explain the bill. 

 

Senator Eltife sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the house bill as engrossed.  Senator Eltife moved adoption of the committee substitute; without objection, it was so ordered.

Senator Harris moved that HB 394 be left pending to await a quorum; without objection, it was so ordered.   

 

The roll was called and a quorum was established.

 

The chair laid out HB 1052 and recognized the Senate sponsor, Senator Deuell, to explain the bill.

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Deuell moved that HB 1052 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Deuell moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The Chair laid out HB 3896 and moved to adopt the committee substitute. The Chair moved that HB 3896 do not pass but that CSHB 3896 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Eltife assumed the chair. 

 

The Chair laid out HB 773 and recognized Senator Harris for a motion. Senator Harris moved that HB 773 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.

The Chair laid out HB 394 and recognized Senator Eltife for a motion. Senator Eltife moved that HB 394 do not pass but that CSHB 394 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.

The chair laid out as a matter of pending business HB 4525 and recognized the Senate sponsor, Senator Ellis, to explain the bill. 

 

Senator Eltife sent up a committee substitute; the chair recognized Senator Ellis to explain the difference between the committee substitute and the house bill as engrossed. 

 

At 9:50 a.m. Senator Harris moved that the committee stand recessed until 10:00a.m.; without objection, it was so ordered. 

 

The Chair laid out HB 2169 and recognized Senator Eltife for a motion. Senator Eltife moved that HB 2169 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Harris moved that HB 4525 be left pending; without objection, it was so ordered. 

 

The following motions in writing were received from the following Committee members. Senator Watson requested to be shown voting aye on the following House bills, 394, 773, 1052, 3222, and 3896. Senator Zaffirini requested to be shown voting aye on the following House bills, 394, 773, 1052, 1277, 2169, and 3222.

 

There being no further business, at 10:06 a.m. Senator Harris moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
