Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, March 3, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:34 a.m.  The following business was transacted: 

 

The chair laid out SB 956 and recognized the author, Senator West, to explain the bill. 

 

At 8:39 a.m. the roll was called, and quorum was present

 

Senator Patrick moved adoption of the minutes from the previous hearing held on February 24, 2009; without objection, it was so ordered. 

 

Senator West sent up a committee substitute; the chair recognized Senator West to explain the difference between the committee substitute and the senate bill as filed.  Senator West moved adoption of the committee substitute; the committee substitute was adopted by a roll call vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 956 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 38 and recognized the author, Senator Zaffirini, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 9:58 a.m. Senator Patrick assumed the chair. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Patrick left SB 38 pending.    

 

The chair laid out SB 401 and recognized the author, Senator Seliger, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator Averitt sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed. 

 

At 10:24 a.m. Senator Shapiro resumed the chair. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Averitt moved adoption of the committee substitute; without objection, it was so ordered.  Senator Averitt moved that SB 401 do not pass but that CSSB 401 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.

 

The chair laid out SB 574 and recognized the author, Senator Jackson, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 574 be left pending; without objection, it was so ordered. 

 

At 10:51 a.m. Senator Shapiro moved that the committee stand recessed until 30 minutes after the adjournment of the Senate; without objection, it was so ordered. 

 

Senator Patrick reconvened the meeting at 12:48 p.m.

 

The chair laid out SB 503 and recognized the author, Senator Eltife, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Patrick moved that SB 503 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 688 and recognized the author, Senator Wentworth, to explain the bill. 

Senator Patrick sent up Committee Amendment 1.  Senator Patrick sent up Committee Amendment 2 in lieu of the author, Senator Shapiro, and explained the amendment.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Patrick moved that SB 688 be left pending; without objection, it was so ordered. 

 

As a matter of pending business, the chair re-opened public testimony for SB 574 and public testimony continued.

 

At 2:02 p.m. Senator Shapiro resumed the chair.    

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  SB 574 was left pending.

 

At 2:15 p.m. Senator Williams assumed the chair. 

 

The chair laid out SB 644 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.   

 

Senator Williams moved that SB 644 be left pending; without objection, it was so ordered.   

 

At 2:35 p.m. Senator Shapiro resumed the chair. 

 

There being no further business, at 2:35 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
