Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Thursday, April 23, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:36 a.m.  The following business was transacted:

 

The chair laid out SB 2249 and recognized the author, Senator Zaffirini, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

The chair left the bill pending.

 

At 9:37 a.m. clerk called the roll and a quorum was established.

 

The chair laid out SB 1489 and recognized the author, Senator Watson, to explain the bill.  Senator Patrick moved to withdraw the substitute previously sent up on April 7, 2009.  Senator Patrick sent up a new committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.  Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered.  Senator Patrick moved that SB 1489 do not pass but that CSSB 1489 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out SB 2258 and recognized the author, Senator Zaffirini, to explain the bill.  Senator Patrick sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

At 9:52 a.m. Senator Patrick assumed the chair.    

 

Senator Shapiro sent up Committee Amendment 1 and was recognized to explain it.  Senator Shapiro withdrew the amendment.

 

At 9:52 a.m. Senator Shapiro resumed the chair. 

 

The chair moved adoption of the committee substitute; without objection, it was so ordered. Senator Patrick moved that SB 2258 do not pass but that CSSB 2258 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

At 9:54 a.m. Senator Shapiro moved that the committee stand recessed until 10:00 a.m.; without objection, it was so ordered.

 

At 10:00 a.m. the committee reconvened.

 

At 10:00 a.m. Senator Patrick assumed the chair. 

 

The chair laid out SB 2082 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Shapiro sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Shapiro requested unanimous consent to roll the amendment into the bill to create a new committee substitute; without objection, it was so ordered.  Senator Shapiro then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Shapiro moved that SB 2082 do not pass but that CSSB 2082 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.   

 

At 10:25 a.m. Senator Shapiro resumed the chair. 

 

The chair laid out SB 2357 and recognized the author, Senator Gallegos, Jr., to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Patrick moved that SB 2357 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator Gallegos, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.     

 

As a matter of pending business, the chair laid out SB 548 and recognized the author, Senator Zaffirini, to explain the bill.  Senator Shapiro moved to withdraw the committee substitute to SB 548 that had been previously sent up, without objection, it was so ordered.  Senator Gallegos, Jr. sent up a new committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  The chair moved adoption of the committee substitute; without objection, it was so ordered.

 

The chair left the bill pending.

 

As a matter of pending business, the chair laid out SB 21 and Senator Gallegos, Jr. sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.

At 10:33 a.m., Senator Shapiro moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered. 

 

Pursuant to the suspension of Senate Rule 11.10 and 11.18 at 3:42 pm the committee reconvened at Senator Shapiro’s desk.

 

The clerk called the roll.  There being a quorum present the following business was transacted:

 

As a matter of pending business, the chair laid out SB 548 and Senator Van de Putte moved adoption of the committee substitute that had been previously sent up by Senator Gallegos, Jr.; without objection, it was so ordered.  The chair recognized Senator Zaffirini to explain the difference between the committee substitute, and the senate bill as filed.  Senator Van de Putte moved that SB 548 do not pass but that CSSB 548 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.    

 

Senator Davis requested unanimous consent to be shown voting aye on SB 2082, and SB 2357; there being no objection, it was so ordered.

 

Senator Gallegos requested unanimous consent to be shown voting aye on SB 1489, and SB 2258; there being no objection, it was so ordered.

Senator West requested unanimous consent to be shown voting aye on SB 2258; there being no objection, it was so ordered.

 

Senator Williams requested unanimous consent to be shown voting aye on SB 1489; there being no objection, it was so ordered.
