Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Thursday, April 9, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:37 a.m.  There being a quorum present, the following business was transacted: 

 

The roll was called, and a quorum was confirmed.

 

The chair laid out as a matter of pending business SB 254.  Senator Lucio, Jr. moved that SB 254 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Shapiro and Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 402.  Senator Eltife moved that SB 402 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent. Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 469, and a committee substitute sent up at a previous hearing.  Senator Zaffirini moved adoption of the committee substitute; without objection, it was so ordered.   Senator Ogden moved that SB 469 do not pass but that CSSB 469 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.  Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

The chair laid out as a matter of pending business SB 629, and a committee substitute adopted at a previous hearing.  Senator West moved to reconsider the vote by which the committee substitute had previously been adopted; without objection, it was so ordered.  Senator West moved to pull down the previously adopted committee substitute; without objection, it was so ordered.  Senator West sent up a new committee substitute; the chair recognized Senator West to explain the difference between the committee substitute and the senate bill as filed.  Senator West moved adoption of the committee substitute; without objection, it was so ordered. 

Senator West moved that SB 629 do not pass but that CSSB 629 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator West moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 873, and a committee substitute sent up at a previous hearing.  Senator Harris moved adoption of the committee substitute; without objection, it was so ordered.   Senator Harris moved that SB 873 do not pass but that CSSB 873 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
