Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on State Affairs was held on Tuesday, April 21, 2009, at Senator Duncan's Desk.

The chair called the meeting to order at 2:35 p.m. There being a quorum present, the following business was transacted:
The chair laid out as a matter of pending business SB 442. Senator Lucio, Jr. moved that SB 442 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
The chair laid out as a matter of pending business SB 671. Senator Lucio, Jr. moved that SB 671 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. Senator Lucio, Jr., being on the prevailing side, moved to reconsider the vote by which SB 671 was passed; without objection, it was so ordered. Senator Van de Putte previously sent up a committee substitute. Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered. Senator Lucio, Jr. moved that SB 671 do not pass but that CSSB 671 be reported back to the Senate with the recommendation that it do pass and be printed.

Senator Fraser moved that SB 1358 do not pass but that CSSB 1358 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 2 nays, 0 present not voting, and 1 absent. Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Duncan moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Lucio, Jr. sent up a new committee substitute; the chair explained the difference between the committee substitute and the senate bill as filed. Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered. Senator Lucio, Jr. moved that SB 1895 do not pass but that CSSB 1895 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
There being no further business, at 2:43 p.m. Senator Duncan moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
