Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Natural Resources was held on Monday, March 30, 2009, at Senator Averitt's Desk.

The chair called the meeting to order at 3:52 p.m.  There being a quorum present, the following business was transacted: 

 

 

 

The chair laid out as a matter of pending business SB 184.

 

Senator Seliger moved that SB 184 do not pass but that CSSB 184 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

The chair laid out as a matter of pending business SB 1040.

 

Senator Uresti moved that SB 1040 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1190.

 

Senator Seliger moved that SB 1190 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

The chair laid out as a matter of pending business SB 1238.

 

Senator Hinojosa moved that SB 1238 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 1 nay, 0 present not voting, and 0 absent. 

 

The chair laid out as a matter of pending business SB 1386.

 

Senator Seliger moved that SB 1386 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Hinojosa moved that SB 1541 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1544. 

 

Senator Averitt sent up a committee substitute and explained the differences in the committee substitute and the senate bill as filed at a previous hearing.  Senator Averitt moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Averitt moved that SB 1544 do not pass but that CSSB 1544 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Averitt moved that SB 1658 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent.

Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1755.

 

Senator Fraser moved that SB 1755 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Fraser moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
