Amend CSHB 400 (house committee printing) as follows:

(1)  On page 9, between lines 7 and 8, insert the following appropriately numbered SECTION into the bill:

SECTION ____.  Section 22.0512(a), Education Code, is amended to read as follows:

(a)  A professional employee of a school district may not be subject to disciplinary proceedings for the employee's objectively reasonable use of physical force against a student to the extent justified under Section 9.62, Penal Code.

(2)  On page 25, between lines 2 and 3, insert the following appropriately numbered SECTION into the bill:

SECTION ____.  Section 22.0512(a), Education Code, as amended by this Act, applies only to a school district employee disciplinary proceeding for conduct that occurs on or after September 1, 2011. A school district employee disciplinary proceeding for conduct that occurs before September 1, 2011, is governed by the law in effect on the date the conduct occurs, and that law is continued in effect for that purpose.

(3)  Renumber SECTIONS of the bill appropriately.
