AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Interested parties contend that current statutes do not adequately address the ability of certain state law enforcement agencies or the adjutant general's department to use appropriated funds to purchase food for certain training events.  Because of this, per diem payments are made, which often results in greater costs to the entity and in lost training time as training participants must leave the training location for meals.  H.B. 78 addresses this problem by authorizing certain state law enforcement agencies and the adjutant general's department to purchase food and beverages for training functions.

 

H.B. 78 amends current law relating to the purchase of food and beverages by certain state law enforcement agencies for peace officer training functions.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 88, Education Code, by adding Section 88.1035, as follows:

 

Sec. 88.1035.  USE OF FUNDS TO SUPPORT PEACE OFFICER TRAINING.  Authorizes the Texas Forest Service (TFS), subject to the approval of the director of TFS, to use appropriated funds to purchase food and beverages for training functions required of peace officers of TFS.

 

SECTION 2.  Amends Subchapter A, Chapter 411, Government Code, by adding Section 411.0132, as follows:

 

Sec. 411.0132.  USE OF FUNDS TO SUPPORT PEACE OFFICER TRAINING.  Authorizes the Department of Public Safety of the State of Texas (DPS), subject to the public safety director's approval, to use appropriated funds to purchase food and beverages for training functions required of peace officers of DPS.

 

SECTION 3.  Amends Subchapter B, Chapter 431, Government Code, by adding Section 431.0296, as follows:

 

Sec. 431.0296.  USE OF FUNDS TO SUPPORT MILITARY POLICE TRAINING.  Authorizes the adjutant general's department, subject to the adjutant general's approval, to use appropriated funds to purchase food and beverages for training functions required of the military police of the state military forces.

 

SECTION 4.  Amends Subchapter B, Chapter 11, Parks and Wildlife Code, by adding Section 11.0195, as follows:

 

Sec. 11.0195.  USE OF FUNDS TO SUPPORT PEACE OFFICER TRAINING.  Authorizes the Texas Parks and Wildlife Department (TPWD), subject to the approval of the executive director of TPWD, to use appropriated funds to purchase food and beverages for training functions required of peace officers of TPWD.

 

SECTION 5.  Effective date: upon passage or September 1, 2011.
