AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Corporal David Slaton of the Department of Public Safety of the State of Texas (DPS) was killed in the line of duty on September 20, 2010, in Montague County.  The trooper was a popular figure in the area known for his good humor and jovial personality.  As a show of respect, the Montague County Commissioners Court requested, and the Texas Department of Transportation subsequently approved, the naming of a section of U.S. Highway 81 in honor of Trooper Slaton.  H.B.  314 amends the Transportation Code to designate the Corporal David Slaton Memorial Highway.

 

H.B. 314 amends current law relating to the designation of a portion of U.S. Highway 81 as the Corporal David Slaton Memorial Highway.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 225, Transportation Code, by adding Section 225.082, as follows:

 

Sec.  225.082.  CORPORAL DAVID SLATON MEMORIAL HIGHWAY.  (a)  Provides that the portion of U.S. Highway 81 from the Texas-Oklahoma border to the northern municipal boundary of Bowie is designated as the Corporal David Slaton Memorial Highway.

 

(b) Requires the Texas Department of Transportation (TxDOT), subject to Section 225.021(c) (relating to the provision that TxDOT is not required to design, construct, or erect a marker unless a grant or donation is provided) to:

 

(1) design and construct markers indicating the highway number, the designation as the Corporal David Slaton Memorial Highway, and any other appropriate information ; and

 

(2) erect a marker at each end of the highway and at appropriate intermediate sites along the highway.

 

(c) Provides that in this section, a reference to the municipal boundary of Bowie means that boundary as it exists on September 1, 2011.

 

SECTION 2.  Effective date: upon passage or September 1, 2011.
