BACKGROUND AND PURPOSE

Current law governing the additional powers of a rural or urban transit district grants a transit district the power to contract with any governmental agency, private individual, or corporation.  However, additional powers relating to a transit district's transportation system are not addressed.  C.S.H.B. 423 grants a rural or urban transit district the power to adopt rules for the safe and efficient operation and maintenance of the transit district's transportation system. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

C.S.H.B. 423 amends the Transportation Code to authorize the governing body of a rural or urban transit district, by resolution, to adopt rules for the safe and efficient operation and maintenance of the transit district's transportation system and adds an exception prohibiting the rules from relating to a license to carry a concealed handgun.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.

COMPARISON OF ORIGINAL AND SUBSTITUTE

C.S.H.B. 423, in provisions authorizing the governing body of a rural or urban transit district to adopt rules for the safe and efficient operation and maintenance of the transit district's transportation system, contains an exception not included in the original prohibiting the rules from relating to a license to carry a concealed handgun.
