AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 427 amends current law relating to the creation of the Rowlett Waterfront Entertainment Management District and provides authority to impose a tax, levy an assessment, and issue bonds.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3896, as follows:

 

CHAPTER 3896.  ROWLETT WATERFRONT ENTERTAINMENT MANAGEMENT DISTRICT

 

Sets forth standard language for the creation of the Rowlett Waterfront Entertainment Management District (district) in the City of Rowlett (city).  Sets forth standard procedures, requirements, and criteria for:

 

Definitions, creation and nature of district, purpose; declaration of intent, findings of benefit and public purpose, district territory, eligibility for reinvestment or enterprise zones, applicability of municipal management districts law, liberal construction of chapter  (Sections 3896.001-3896.050);

 

Size for board of directors, appointment of directors; terms, nonvoting directors, conflicts of interest, directors oath or affirmation, officers, compensation of directors; reimbursement of expenses, initial directors and quorum (Sections 3896.051-3896.100);

 

Powers and duties of the district, improvement projects, general powers regarding contracts, competitive bidding, economic development, rules; enforcement, name change, adding or removing territory, no eminent domain power and district employees; terms of employment (Sections 3896.3896.101-3896.150);

 

General financial provisions and powers, borrowing money, impact fees and assessments; exemption, certain residential property not exempt, maintenance and operation tax; election, use of surplus maintenance and operation, bond issuance plan required before issuing bonds, bonds and other obligations; municipal approval, bond maturity, taxes for bonds and other obligations, project development agreement required to impose taxes or borrow money, including bonds and city not required to pay district obligations (Sections 3896.151-3896.200);

 

Dissolution of the district by city, collection of assessments and other revenue, assumption of assets and liabilities (Sections 3896.201-3896.203).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2.  Sets forth initial boundaries of the district.


SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2011.
