AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, legislators receive information and notices from the Texas Commission on Environmental Quality (TCEQ).  Because that notification system requires a large quantity of paper, this bill requires that TCEQ utilize electronic means of transmission for any notice it issues or sends a state senator or state representative, unless the senator or representative requests to receive notices by mail.

 

H.B. 610 amends current law relating to certain notices sent by the Texas Commission on Environmental Quality.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 5.128, Water Code, by amending Subsection (a) and adding Subsections (a-1), (a-2), and (a-3), as follows:

 

(a)  Makes nonsubstantive changes.

 

(a-1) Creates this subsection from existing text.  Authorizes the Texas Commission on Environmental Quality (TCEQ), notwithstanding any other law, to utilize electronic means of transmission of information, including, notices, orders, and decisions issued or sent by TCEQ.  Makes nonsubstantive changes.

 

(a-2) Requires TCEQ to utilize electronic means of transmission for any notice issued by TCEQ to a state senator or representative, unless the senator or representative has requested to receive notice by mail.

 

(a-3) Requires that the notice, if the notice issued or sent under Subsection (a-2) concerns a permit for a facility, include an Internet link to an electronic map indicating the location of the facility.

 

SECTION 2.  Effective date: September 1, 2011.
