BACKGROUND AND PURPOSE

It has been reported that an applicant for a license issued by the Commission on Law Enforcement Officer Standards and Education (TCLEOSE) who must submit an application twice as a result of a processing error of the commission cannot receive a refund or credit for the application fee submitted with the first application.  Allegedly, TCLEOSE is not able to do this because current statute does not provide for refunding or crediting of fees.

H.B. 633 seeks to address this issue by authorizing TCLEOSE to refund an application fee, including one that is otherwise nonrefundable, under certain circumstances.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 633 amends the Occupations Code to authorize the Commission on Law Enforcement Officer Standards and Education to refund an application fee for a license issued by the commission as a law enforcement officer, county jailer, or public security officer, including a fee that is otherwise nonrefundable, if the commission determines the application was submitted by mistake.  

EFFECTIVE DATE

September 1, 2011.
