AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The continuing advisory committee for special education services, as appointed by the governor, does not currently have a director of special education programs on the committee.  A practitioner in special education with a broad knowledge of current programs is needed to bring local, first-hand experience to the committee.

 

H.B. 861 requires that at least one of the 17 members on the continuing advisory committee for special education services be a director of special education programs for a school district or for a shared services arrangement of multiple school districts.  A special education program director will contribute to the advisory committee the perspective and knowledge of a professional who is familiar with statewide and local programs that serve over 440,000 students daily.

 

H.B. 861 amends current law relating to membership of the state continuing advisory committee for special education services.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 29.006, Education Code, as follows:

 

Sec. 29.006.  CONTINUING ADVISORY COMMITTEE.  (a) Creates this subsection from existing text. Requires the governor to appoint a continuing advisory committee, composed of 17 members, under 20 U.S.C. Section 1412(a)(21).  Requires that at least one member appointed under this subsection be a director of special education programs for a school district or for a shared services arrangement of multiple school districts as provided by Section 29.007 (Shared Services Arrangements).

 

(b)  and (c) Creates these subsections from existing text.  Makes no further changes.

 

SECTION 2.  Requires the governor, not later than February 1, 2013, to appoint a member to the continuing advisory committee as necessary to ensure that the composition of the committee complies with Section 29.006, Education Code, as amended by this Act.

 

SECTION 3.  Effective date: upon passage or September 1, 2011.
