BACKGROUND AND PURPOSE

 

The enabling legislation for the Lubbock County Hospital District of Lubbock County, Texas, established a board of not fewer than five and not more than seven managers. Several sessions ago, the legislation was amended to add an ex officio board member to be appointed by the Texas Tech University Board of Regents. Since that time, the Commissioners Court of Lubbock County has continued to appoint seven members to the board, resulting in the board having eight members, which exceeds the current statutory limit.  H.B. 923 intends to resolve this issue by allowing for the appointment of not fewer than six and not more than eight managers to the board. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 923 amends the Special District Local Laws Code to raise the minimum and maximum number of managers on the board of hospital managers of the Lubbock County Hospital District of Lubbock County, Texas, from not fewer than five and not more than seven managers to not fewer than six and not more than eight managers.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
