AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1046 amends current law relating to the confidentiality of certain personal information concerning current and former employees of certain divisions of the office of attorney general.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 552.117(a), Government Code, to provide that information is excepted from the requirements of Section 552.021 (Availability of Public Information) if it is information that relates to the home address, home telephone number, or social security number of certain persons or that reveals whether the person has family members including a current or former employee of the office of the attorney general (OAG) who is or was assigned to a division of OAG the duties of which involve law enforcement, regardless of whether the current or former employee complies with Section 552.024 (Electing to Disclose Address and Telephone Number) or 552.1175 (Confidentiality of Addresses, Telephone Numbers, Social Security Numbers, and Personal Family Information of Peace Officers, County Jailers, Security Officers, and Employees of the Texas Department of Criminal Justice or a Prosecutor's Office).  Makes a nonsubstantive change.

 

SECTION 2.  Amends Section 552.1175(a), Government Code, to provide that this section applies only to certain persons, including current and former employees of OAG who are or were assigned to a division of OAG the duties of which involve law enforcement.  Makes a nonsubstantive change.

 

SECTION 3.  Amends Section 25.025(a), Tax Code, to provide that this section applies only to certain persons, including a current or former employee of OAG who is or was assigned to a division of OAG the duties of which involve law enforcement.  Makes a nonsubstantive change.

 

SECTION 4.  Effective date: upon passage or September 1, 2011.
