BACKGROUND AND PURPOSE

School health advisory councils are district-level councils composed of parents, teachers, students, health professionals, and community leaders who are responsible for creating strategies to integrate health curricula into a coordinated school health program that reflects local values. Although the board of trustees of a school district is required to appoint at least five members to the local school health advisory council, there is no requirement that the potential members commit to serving for a certain amount of time before being appointed. C.S.H.B. 1095 seeks to implement such a requirement.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

C.S.H.B. 1095 amends the Education Code to authorize a person to be appointed as a member of a school district's local school health advisory council only if, before appointment, the person agrees to serve for at least one year.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.

COMPARISON OF ORIGINAL AND SUBSTITUTE

C.S.H.B. 1095 differs from the original by authorizing a person to be appointed as a member of a school district's local school health advisory council only if, before appointment, the person agrees to serve for at least one year, whereas the original authorizes such an appointment only if the person agrees to serve for at least two years.
