AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1144 provides that repeated absence from regularly scheduled board meetings is a ground for removal from the Hopkins County Hospital District board of directors (district; board).  For this ground for removal to apply, a member must be absent from at least four meetings in any 12-month period without an excuse approved by a majority vote of the board.  Procedures for removal will follow those established in Subchapter B (Removal by Petition and Trial), Chapter 87 (Removal of County Officers from Office; Filling of Vacancies), Local Government Code, for removal of a county official.

 

H.B. 1144 also changes the length of time that a bank serves as the designated depository or treasurer for the district from two years to three years.

 

H.B. 1144 amends current law relating to the Hopkins County Hospital District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 1043, Special District Local Laws Code, by adding Section 1043.0535, as follows:

 

Sec. 1043.0535.  GROUNDS FOR REMOVAL.  (a)  Provides that it is a ground for removal from the board of directors of the Hopkins County Hospital District (board; district) that a director is absent from at least four regularly scheduled board meetings that the director is eligible to attend in any 12-month period without an excuse approved by a majority vote of the board.

 

(b)  Provides that the validity of an action of the board is not affected by the fact that the action is taken when a ground for removal of a director exists.

 

(c)  Authorizes a director to be removed for a ground provided by this section using the procedures provided by Subchapter B (Removal by Petition and Trial), Chapter 87 (Removal of County Officers from Office; Filling of Vacancies), Local Government Code, for removing a county official.

 

SECTION 2.  Amends Section 1043.155(a), Special District Local Laws Code, to provide that a designated bank serves as the district's depository or treasurer for three years, rather than two years, and until a successor is designated.

 

SECTION 3.  Effective date: upon passage or September 1, 2011.
