AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Interested parties report that each school district in a certain county employs its own peace officers. The goal of H.B. 1254 is to address this situation by adding a provision to current law relating to consideration of the consolidation of school district employment of peace officers and security personnel.

 

H.B. 1254 amends current law relating to consideration of the consolidation of school district employment of peace officers and security personnel in certain counties.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter C, Chapter 37, Education Code, by adding Section 37.0815, as follows:

 

Sec. 37.0815.  CONSIDERATION OF COUNTYWIDE EMPLOYMENT OF SCHOOL DISTRICT PEACE OFFICERS AND SECURITY PERSONNEL.  (a)  Provides that this section applies only to a county with a population of 800,000 or more that is located adjacent to an international border.

 

(b)  Requires the school districts in a county subject to this section, not later than January 1, 2012, to meet and discuss countywide consolidation of school district employment of peace officers and security personnel.  Requires the districts to collect and review information related to the employment of peace officers and security personnel by each district and discuss the feasibility and advisability of consolidating that employment.

 

(c)  Requires the school district, not later than May 1, 2012, to provide a joint report to the commissioner of education:

 

(1)  summarizing the information collected and reviewed under Subsection (b); and

 

(2)  providing recommendations concerning the feasibility and advisability of countywide consolidation of school district employment of peace officers and security personnel based on the discussions under Subsection (b).

 

(d)  Provides that this section expires September 1, 2012.

 

SECTION 2.  Effective date: upon passage or September 1, 2011.
