AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The enabling legislation for Moore County Hospital District was enacted by the 61st Legislature in 1969.  Two provisions of the enabling legislation have become out-of-date since being enacted.  H.B. 1293 modernizes the language referring to eldercare to reflect current industry terminology.  This bill also links the construction or purchase contract amount to the amount provided by Section 271.024 (Competitive Procurement Procedure Applicable to Contract), Local Government Code.

 

H.B. 1293 amends current law relating to the Moore County Hospital District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 1064.104(b), Special District Local Laws Code, as effective April 1, 2011, to authorize the Moore County Hospital District system to include certain facilities, including facilities for geriatric care, rather than geriatric domiciliary care, including assisted living facilities and independent elderly living facilities, and nursing home facilities, rather than convalescent home facilities.

 

SECTION 2.  Amends Section 1064.110(a), Special District Local Laws Code, to authorize a construction or purchase contract that involves the expenditure of more than the amount provided by Section 271.024 (Competitive Procurement Procedure Applicable to Contract), Local Government Code, rather than more than $15,000,  to be made only after advertising in the manner provided by Subchapter B (Competitive Bidding on Certain Public Works Contracts), Chapter 271 (Purchasing and Contracting Authority of Municipalities, Counties, and Certain Other Local Governments), Local Government Code.

 

SECTION 3.  Effective date: upon passage or September 1, 2011.
