BACKGROUND AND PURPOSE

 

The enabling legislation for the Moore County Hospital District was enacted many years ago.  Two provisions of the enabling legislation have since become outdated.  H.B. 1293 seeks to modernize language referring to geriatric care to reflect current industry terminology and to link the construction or purchase contract amount to the amount provided by statutory provisions. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 1293 amends the Special District Local Laws Code, as effective April 1, 2011, in a provision authorizing a hospital system established by the Moore County Hospital District to include facilities for geriatric domiciliary care, specifies such facilities to be for geriatric care and includes among such facilities assisted living facilities and independent elderly living facilities.  The bill authorizes such a hospital system to include nursing home facilities, rather than convalescent home facilities. The bill authorizes a district construction or purchase contract that involves the expenditure of more than $50,000 as applicable to certain local governmental entities for certain public works contracts, rather than of more than $15,000, to be made only after advertising in the manner provided by applicable competitive bidding provisions.

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
