AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current statute concerning classifying a vehicle as "junk" is ambiguous and often interpreted differently by various municipalities.

 

H.B. 1376 offers clarification to reflect what many municipalities believe the intent of the law is by amending the language concerning the display or lack of a license plate or inspection certificate.

 

H.B. 1376 amends current law relating to the definition of a junked vehicle for purposes of abatement of a public nuisance.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 683.071, Transportation Code, to redefine, in this subchapter, "junked vehicle."

 

SECTION 2.  Effective date: September 1, 2011.
