BACKGROUND AND PURPOSE

 

The El Paso County Water Control and Improvement District No. 4 was created to provide clean water to the residents of the community of Fabens, and the district's territory, as described in the legislation creating the district, remains unchanged.  Due to growth in adjoining areas, the district began providing services to customers located in an area just outside its established territory and within the jurisdiction of the Lower Valley Water District, and subsequent legislation attempted to resolve the status of that area. However, that legislation stated new boundaries that were excluded from the territory of the Lower Valley Water District, and the official record still reflects the original territory for the El Paso County Water Control and Improvement District No. 4.  Because of this, the district experiences difficulties when involved in issues or bids that require a legal description of the district's territory.   H.B. 1383 establishes the territory for the expanded district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 1383 amends Chapter 58, Acts of the 54th Legislature, Regular Session, 1955, to set forth in detail the territory of the El Paso County Water Control and Improvement District No. 4.  The bill provides that the boundaries and field notes specified in the bill form a closure and that a mistake made in the field notes or in copying the field notes in the legislative process does not affect the district's organization, existence, or validity; right to issue any type of bond for the purposes for which the district is created or to pay the principal of and interest on a bond; right to impose a tax; or legality or operation.  The bill defines "district."

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
