BACKGROUND AND PURPOSE

Interested parties note that legislation is required to allow political subdivisions in Texas to adopt an ordinance, rule, or regulation authorizing or requiring a business establishment in that political subdivision that engages in over-the-counter sales of products containing ephedrine, pseudoephedrine, or norpseudoephedrine to use an electronic reporting database in addition to any other reporting or recordkeeping required under provisions of law.  H.B. 1626 seeks to provide political subdivisions this tool to combat illegal drug use.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 1626 amends the Health and Safety Code to specify that provisions of law establishing the statewide application and uniformity of statutory provisions relating to over-the-counter sales of ephedrine, pseudoephedrine, or norpseudoephedrine do not preclude a political subdivision from adopting an ordinance, rule, or regulation authorizing or requiring a business establishment in that political subdivision that engages in over-the-counter sales of products containing ephedrine, pseudoephedrine, or norpseudoephedrine to use an electronic reporting database in addition to any other reporting or recordkeeping required under state law.

EFFECTIVE DATE

September 1, 2011.
