BACKGROUND AND PURPOSE

 

Current law requires an annual review of equipment and personal property owned by the Parks and Wildlife Department (TPWD) and real property owned or operated by TPWD to determine if the equipment has become outdated; determine whether a task relating to the maintenance of personal or real property performed by TPWD could be performed by a third-party contractor at less cost and with equal or better quality; and submit to the governor, lieutenant governor, and certain members of the legislature a biennial management plan and a priorities list that includes the results of those reviews, as well as a priority listing of facilities operated by TPWD that are most in need of maintenance and a list of additional funding requested by TPWD to address those priority needs. H.B. 1843 repeals the provisions of law establishing those review and reporting requirements.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 1843 repeals Subchapter K, Chapter 11, Parks and Wildlife Code, requiring management and efficiency reviews to be established by the Parks and Wildlife Commission and conducted by the Parks and Wildlife Department (TPWD) of equipment and personal property owned by TPWD and real property owned or operated by TPWD, the sale of any equipment determined to be outdated, the deposit of the proceeds of the sale of equipment to the credit of the appropriate parks and wildlife account, the performance of maintenance tasks in certain circumstances by a third-party contractor, and the submission of a management plan and maintenance priorities list to the governor, speaker of the house of representatives, lieutenant governor, and the chair of each house and senate standing committee having jurisdiction over a matter regulated by TPWD.
