BACKGROUND AND PURPOSE

A person assisting a voter is currently required to swear an oath administered by an election officer at the voting place before assistance is offered. H.B. 2051 seeks to expand the oath to reflect language in provisions of law governing persons providing assistance to a voter.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2051 amends the Election Code to include in the oath a person selected to provide assistance to a voter is required to take, as administered by an election officer at the polling place and before providing such assistance, a statement affirming that the person is not the voter's employer, an agent of the voter's employer, or an officer or agent of a labor union to which the voter belongs.

EFFECTIVE DATE

September 1, 2011.
