AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, if an employee on a continuing or term contract is reassigned to a new professional capacity within a school district, that person continues employment on a continuing or term contract.  Interested parties say this occurs even through there is no guarantee that someone serving in one capacity will succeed in another.  H.B. 2380 seeks to establish the flexibility necessary for a school district to keep the best personnel serving in key educational roles by changing statutes relating to employment by a school district of certain persons under probationary contracts. 

 

H.B. 2380 amends current law relating to employment by school districts of certain persons under probationary contracts.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 21.102, Education Code, by adding Subsection (a-1), as follows:

 

(a-1)  Authorizes a person who voluntarily accepts an assignment in a new professional capacity that requires a different class of certificate under Subchapter B (Certification of Educators) than the class of certificate held by the person in the professional capacity in which the person was previously employed to be employed under a probationary contract.  Provides that this subsection does not apply to a person who is returned by a school district to a professional capacity in which the person was employed by the district before the district employed the person in the new professional capacity as described by this subsection.   Entitles a person described by this subsection who is returned to a previous professional capacity to be employed in the original  professional capacity under the same contractual status as the status held by the person during the previous employment by the district in that capacity.

 

SECTION 2.  Effective date: upon passage or September 1, 2011.
