BACKGROUND AND PURPOSE

 

Harris County Improvement District No. 5 is a management district and currently provides services and improvements to the area within the district.  C.S.H.B. 2670 seeks to add territory to the district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 2670 enlarges the boundaries of Harris County Improvement District No. 5, sets out in detail the boundaries of the additional land, and makes provision for certain mistakes in the description of the boundaries.

 

C.S.H.B. 2670 establishes that the legislature validates and confirms all governmental acts and proceedings of the district that were taken before the effective date of the bill. The bill prohibits an act or proceeding from being held invalid because the act or proceeding was not in accordance with statutory provisions relating to the district or other law. The bill makes such validation, confirmation, and prohibition inapplicable to any matter that on the effective date of the bill is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment or to any matter that on the effective date of the bill has been held invalid by a final court judgment.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.

 

COMPARISON OF ORIGINAL AND SUBSTITUTE

 

C.S.H.B. 2670 differs from the original in provisions relating to the boundaries of the additional land of Harris County Improvement District No. 5 by establishing that the district is also known as Brays Oaks Management District and making reference to that name instead of Harris County Improvement District No. 5.  The substitute differs from the original by making a change to the boundaries.
