BACKGROUND AND PURPOSE

 

Two bills were passed during the last regular session that amended the same statutes with similar but non-identical language.  H.B. 2771 seeks to reenact certain provisions in order to eliminate any possible confusion or ambiguity resulting from the differing language.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2771 reenacts Sections 60.4035(a), 60.404(a) and (d), and 60.406(a), Water Code, as amended by Chapters 415 (H.B. 1972) and 1191 (H.B. 3785), Acts of the 81st Legislature, Regular Session, 2009, to harmonize the effect of legislation on provisions of law. The bill establishes that, to the extent of any conflict, the bill's provisions prevail over another act of the 82nd Legislature, Regular Session, 2011, relating to nonsubstantive additions to and corrections in enacted codes.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
