AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 2809 amends current law relating to the authority of the board of the Greater Texoma Utility Authority to approve changes in a construction contract.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 8283.155, Special District Local Laws Code, by adding Subsection (c), as follows:

 

(c)  Authorizes the board of directors of the Greater Texoma Utility Authority, if changes in plans or specifications are necessary after performance of a construction contract begins, to approve change orders necessary to decrease or increase the amount of materials, equipment, or supplies to be provided under the contract or the amount of work to be performed.  Prohibits the total cost of the change orders from increasing the original contract price by more than 25 percent.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date:  upon passage or September 1, 2011.
