AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Recreational vehicle (RV) and tow truck shows are held on Saturdays and Sundays, but under current law the vehicles can only be sold on one of those days.  Some observers are concerned that the law prohibits prices from being quoted or posted at the shows on the non-sale day.  This creates a situation in which a show is approved and legal on a certain day but prices cannot be mentioned either verbally or in writing.  H.B. 2872 seeks to allow participants at approved RV and tow truck shows to quote prices on both days of a show that runs on Saturday and Sunday.

 

H.B. 2872 amends current law relating to restrictions on the sale of certain motor vehicles at vehicle shows or exhibitions.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 728.002, Transportation Code, by adding Subsection (d) to provide that this section does not prohibit the quoting of a price for a motor home, tow truck, or towable recreational vehicle at a show or exhibition described by Section 2301.358 (Vehicle Show or Exhibition), Occupations Code.

 

SECTION 2.  Effective date: upon passage or September 1, 2011.
