BACKGROUND AND PURPOSE

Open-enrollment charter schools are part of the Texas public school system, yet a document relating to the performance evaluation of a teacher or administrator employed by a charter school is not currently extended the same confidentiality privilege as is extended to such documents for public school teachers or administrators. H.B. 2971 seeks to remedy this situation by establishing the confidentiality of documents evaluating the performance of charter school teachers and administrators to the same extent as that of public school teachers and administrators.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2971 amends the Education Code to establish a document evaluating the performance of a teacher or administrator employed by an open-enrollment charter school as confidential.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
