BACKGROUND AND PURPOSE

 

According to the American Red Cross, the Heimlich maneuver is no longer the recommended method to assist a person who is choking. The Heimlich maneuver is not necessarily better than other methods and can cause injury when performed incorrectly.

 

H.B. 3065 repeals provisions of law that require signs depicting the Heimlich maneuver to be posted in certain food service establishments.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3065 amends the Health and Safety Code to repeal Subchapter E, Chapter 438, which requires a food service establishment at which space for eating is designed or designated to post in a place conspicuous to employees or customers a sign that depicts the Heimlich maneuver for dislodging food from a choking person, specifies design requirements for the sign, and requires the sign to be printed in English and Spanish.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
