BACKGROUND AND PURPOSE
Texas currently requires certain facilities that provide physical therapy as an auxiliary service to register with the Texas Board of Physical Therapy Examiners. Some facilities, such as facilities that provide occupational therapy, are exempt from such registration requirements. Those involved in the registration process claim that these registration requirements increase the cost to the facility for providing services and do not increase the services allowed to be provided by the facility. H.B. 3369 intends to allow the Texas Board of Physical Therapy Examiners to exempt certain facilities from having to register as a physical therapy facility.

RULEMAKING AUTHORITY
It is the committee's opinion that rulemaking authority is expressly granted to the Texas Board of Physical Therapy Examiners in SECTION 1 of this bill.

ANALYSIS
H.B. 3369 amends the Occupations Code to authorize the Texas Board of Physical Therapy Examiners, by rule, to exempt facilities other than licensed health facilities from the board's physical therapy facility registration requirements as appropriate.

September 1, 2011.
